The bottom line is that it would only come up if somebody ignored the agreement, used their free speech rights to discuss the techniques or "the keys," and/or used examples of materail from "the keys" to critique it, and then Elan Vital/TPRF/Rawat, tried to sue under the contract.

It would be then that a court could decide if that "contract" is enforceable in the first place, or more likely, against public policy.  But that supposes that Rawat would actually go around suing people who went through "the keys" and weren't satisfied, and had the gall to talk about it.  As we have seen with the copyright nonsense, the cult it loathe to do that. 

 It's REALLY bad PR and bad for Rawat's "image" (such as it is) to be seen aggressively going after people, especially given that Rawat is filthy rich and the ordinary people he would go after, aren't.  Yes, that would be bad PR -- probably undo a dozen or so of those canned "interviews" in those fake "magazines" he's in, and paid huge bucks to pretend aren't completely contrived.

Also, who knows what might come out in the course of litigation?

I think the purpose of that "contract" is just to scare people from revealing the techniques (which might mean Rawat would be out of a job), or turn over "keys" material to evil ex-premies who might talk about it rationally, or to the press, who might not have the proper "understanding" that Rawat is above criticism.
