I'm not a lawyer, but I'm pretty sure you can't waive those kind of rights in Germany, though I don't think it makes the entire contract void. I can try to find out more precisely. But honestly I also find it hard to believe that this is legal in the US either. Fair use is part of people's basic civil liberties and you can't sign a contract to give this away, or can you Joe?
