Should a court be able to look behind the arguments to see motivation for a law? For instance, a law passed by a town that all residents must clean their sidewalks every Saturday morning. Seems harmless but what if the court discovered that the real intent was to keep Jews from the town since they had to go to Temple on Saturday morning? I just saw this ? that related to some 1944 ruling |
